eLearning Terms and Conditions

Information about Health Matters (Health & Safety) Limited

The eLearning product(s) purchased are provided by Health Matters (Health & Safety) Limited (Company No. NI053822) and our registered office is at 11 Monaghan Court, Monaghan Street, Newry, BT35 6BH (referred to as “HM” in these terms and conditions). Status of these Terms and Conditions and Updates

These terms and conditions, together with our Privacy Policy, will form a legally binding agreement between you and HM in relation to your use of HM eLearning products. By using the HM eLearning portal, you confirm that you accept these terms and conditions and that you agree to comply with them. If you do not agree to these terms and conditions, you must not use the HM portal and inform us immediately, in writing and via email to [email protected] prior to commencing the online course material.

Access to Courses and Outcome Certification

We will endeavour to allow uninterrupted access to your eLearning material, but access to the courses may be suspended, restricted or terminated at any time. We reserve the right to change, modify, substitute or remove without notice any information in the material from time to time.

You will have access to the courses you have purchased for a fixed period from the date of purchase. Assessment access periods are from the date of purchase and these periods are course specific and detailed within the appending eLearning Enrolment Periods document that accompanies these eLearning terms and conditions within your booking confirmation email.

During the eLearning Enrolment Period, it is the responsibility of the user to download and retain any in-system outcome certificates. Should the enrolment period lapse and the user require HM to recover such certification, a 10% of full course cost administration charge will apply. Please note that this does not apply for any externally certified courses such those certified by the Institute of Occupational Safety and Health (IOSH).

Course Extensions

The eLearning course enrolment period can be extended one time within 3-months of the original expiry date. The one-time extension cost is 25% of the full course cost (without any discount applied). The extension period will be the same duration as the enrolment period provided with the initial booking.

Cancellations, Transfers and Deferment

Courses purchased cannot be cancelled if the user has accessed the Learning Management System (Portal) by logging in.

Courses may be cancelled or deferred* within a timeframe of 14 days from booking, pending the user(s) has not accessed the content.

Where organisations have availed of discounted user banding (multi-user saver plans), and then subsequently cancelled users, resulting in their applicable discount falling within a higher priced band, HM reserve the right to readjust and re-invoice for any outstanding monies owed.

Please note that in-company bulk enrolments discounted costs expire after 6-months of original quote. Thereafter, standard costs apply.

Multi-user saver pricing bands can be viewed on our website. Transfers or ‘name changes’ are not permitted.

*Deferring your course enrolment may result in course costs. For further details, please contact us via email at [email protected]. Please be aware that Health Matters reserves the right to decline deferment for any course access or examination. Any deferment offer must be made in writing to be considered valid. In the event of a deferred entry, please note that the course, its modules, requirements, tutor services, and facilities previously shared may undergo changes. 

Intellectual Property/Copyright

The copyright in the material contained in the courses, together with the design, text and graphics and all software compilation belong to HM. All rights are reserved. None of this material may be downloaded, reproduced, or redistributed without HM’s written permission.

Exclusions of Liability

HM will use reasonable endeavours to ensure that the data in the courses is accurate and to correct any errors or omissions as soon as practicable after being notified of them. To the extent permitted by applicable law, we disclaim all warranties and representations (whether express or implied) as to the accuracy of any information contained in the courses. We do not guarantee that the material will be fault free and do not accept liability for any errors or omissions.

We do not give any warranty that the website and LMS is free from viruses or anything else, which may have a harmful effect on any technology. HM makes no representation whatsoever regarding the content of any other websites, which you may access from the courses. A link to a non-HM website does not mean that HM endorses or accepts any responsibility for the content or use of such websites.

Payment

Payment Card Industry Data Security Standard (PCI DSS) Compliant.

Online bookings have the choice of paying immediately by credit/debit card or PayPal, nominating somebody else to pay on your behalf.

Approved organisations with credit facilities can request an invoice for all other payment methods. This can only be organised via phone or email rather than the website.

Invoices must be paid no more than 30 days from the invoice date unless stated otherwise.

*Please note that the enrolment period begins on the day of booking. Once the enrolment period ends (as detailed above), the course will expire. If the learner has not completed the course within the allotted enrolment period, they will be required to re-book the course at standard cost or extend the enrolment period per our T&C’s at a discounted rate.
